The section 55 offence is an "either way offence" Chris. Therefore, no limitation on proceedings.

An "abuse of process" argument is more likely as the prosecuting authorities have know the circumstances of the alleged offences right from the start( or very near the start) of the investigation but chose not to take any action against the companies instructing the PI's.
