Chris - with regard to processing by the public sector, this is why I think data minimisation is so important. If data (eg on people's Internet use) isn't collected in the first place, statutory gateways or compelled disclosure make no difference. It's also critical that privacy impact assessments take into account how data *could* be used, even if initially there would be no plans to do so.
